Welcome to Anturia.ph, hereinafter called the “site.” The following terms and conditions of accepted practices apply to this web destination, including its divisions, subsidiaries and affiliate-operated sections in the worldwide web. By visiting this Internet location, and using its service features, you confirm your understanding of our terms of use. The owners reserve the rights to alter, change, modify, add, or remove any of its provisions, and may not inform you about it. Any changes will take effect when they are posted. Use of the Site

You are presumed 18 years old, either gaining access with parent supervision or guardian, when you signed up for voluntary registration. The owners affirm that the license we have given for your use of this site is non-transferable but revocable. By this we mean that any violation of the terms shall result to immediate license revocation, of which we are unobligated to inform you. Submissions or opinions expressed here belonged to the individuals who posted them and should not reflect our opinions. Certain services and related features that may later be made available here in the future may require registration or subscription. Should you opt to subscribe or register for any of those services, you agree to a) provide accurate and current information about yourself, and b) to promptly update such information should certain changes occur. Every user or visitor of the site is solely responsible for keeping passwords and other account identifiers safe and secure, and he/she is entirely accountable for all activities and outcomes under such password or account. In case of unauthorized use of your password or account, you must immediately call our attention. The site and its owners shall not be held liable or responsible, directly or indirectly, for any damage or loss of any kind as a result of, in connection with, or arising from your non-compliance with these terms. Although you had agreed, during registration, to receive promotional emails from the site, you have the right to opt out from receiving such emails.

Misuse or abuse of services

Anturia.ph, its owners, and the community of real estate brokers and sellers work hand in hand to keep the site and services working properly and keeping Cebu City safe. We ask you to report to us certain problems, especially offensive content and policy violations. We also endeavor to ensure that none of our property listings infringe upon the copyright, trademark or intellectual property rights of third parties. Let us know if you find your IPR being undermined and/or prejudiced by, or infringed upon; our legal and technical team will immediately investigate,

Submissions from Users

Any information or photograph that you submit or provide to Anturia.ph, including (but not limited to) questions, reviews, comments, and suggestions, individually or collectively, will become our sole/exclusive property and shall not be returned to you. Moreover, when you post comments or communicate with other visitors or users in our blogs, you also grant us the right to use the name that you submitted, in connection with such review, comment or content. You shall not use a false email address, pretend to be someone other than yourself, mislead us and other parties, and misrepresent any other institution, as for the origin of any submission. At times we may (but shall not) be obligated to remove or edit any submission.

Jurisdiction and Applicable Laws

The laws and regulations enforced in the Republic of the Philippines shall have supremacy over interpretation and questions of governance concerning these terms and conditions. In case of need for arbitration, or when litigation arises, visitors and users agree to submit themselves to the jurisdiction of Philippine courts and waive any objections against venue.

Arbitration

Any controversy, claim or dispute arising from (or relating to) these terms and conditions shall be referred to and finally settled by private and confidential binding arbitration before a single arbitrator held in the Philippines in English. Such arbitrator shall be a person who is duly trained and who has had experience in the information technology field in the Philippines and is independent of either party. The site reserves the right to pursue the protection of intellectual property rights and confidential information through injunctive or other equitable relief through the regional trial courts, as the case may be.

Indemnity

You will indemnify and hold us (officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising from your breach of this agreement, or your violation of any law or the rights of a third party, under Philippine laws.

Agency Disclaimer

No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this agreement.

Issuance of Notices

Notices shall be sent to you by email using the email address you voluntarily provided to Anturia.ph during your registration. Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by registered mail to the address you had given. You are deemed to have received the notices sent to you by registered mail three days after the date of mailing.

Termination Clause

The owners, through the web administrators of Anturia.ph or through their duly authorized representatives or officers, may immediately terminate the terms and conditions, or remove any or all of your rights, without notifying you beforehand. When such termination takes effect, you shall immediately cease all access to and use of the site. In addition to any other legal or equitable remedies, we shall immediately revoke all the password(s) and account identification issued to you and deny your access to and use of this site in whole or in part. The respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination shall not be affected by the termination of this agreement. Moreover, you shall also agree that the site shall not be liable to you or to any other person as a result of any such suspension or termination. Should you happen to have dissatisfaction about the site or with any terms, conditions, rules, policies, guidelines, or practices of Anturia.ph, you have sole and exclusive remedy to stop using this website.
